Defendant shall be punished by a fine of KRW 4,500,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
[2015 High Court Decision 4732]
1. A crime committed on June 17, 2014;
A. On June 17, 2014, the Defendant: (a) had not obtained E’s consent for the purpose of using it in the opening of a mobile phone (D); (b) had been recorded in the column for the applicant to join the two applications, which had been kept there without authority; and (c) had forged a copy of the application for joining the mobile phone, which is a private document concerning rights and obligations by private person; (d) had presented the forged application form to CF as a document duly formed.
Accordingly, the defendant forged private documents and used forged private documents.
B. The Defendant submitted a forged application to C employee F in the name of E at the location described in the above paragraph (a) at the time and time, such as the entry in the paragraph (a), and obtained a mobile phone (D) equivalent to KRW 879,600 at the market price from F and acquired it by fraud.
2. A crime committed on June 19, 2014;
A. On June 19, 2014, the Defendant: (a) stated the name of E in the column of the applicant for the two subscription that he/she had obtained the consent of E without authority even though he/she did not have obtained the consent of E for the purpose of using it in the opening of the opening of the mobile phone (I); (b) stated in the column of the applicants for the two subscription that he/she had obtained the consent of E; (c) forged one copy of the application for the mobile phone purchase, which is a private document concerning rights and obligations; and (d) presented it to H employee J who may know the above forgery as a document duly formed.
Accordingly, the defendant forged private documents and used forged private documents.
B. The Defendant, at the time and place set forth in the above A. A. At the same time and place as described in the same paragraph, submitted to the H StaffJ an application for a forged membership under the name of E, and its affiliation is KRW 920,000 at the market price from J.
