A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On July 11, 2017, at around 14:00, the Defendant made a false statement to the D inn's position in training operated by the victim LG U Pplers Co., Ltd., and to the staff “E has obtained permission from the E, thereby allowing the E to subscribe to the Internet and TV in its name.”
However, the nominal E does not have any consent to the subscription of the Internet and TV, and the defendant did not have any intent or ability to subscribe to the Internet and TV in his name.
The Defendant, by deceiving the victim and allowing the victim to subscribe in the name of E on the Internet and TV, and received the gift certificates of KRW 150,00 from the victim on the Internet and TV subscription as the gift certificates of KRW 150,00 from the victim.
Accordingly, the defendant was given property by deceiving the victim.
2. On July 13, 2017, the Defendant forged a private document and the instant investigation document: (a) on July 13, 2017, the Defendant: (b) indicated the application for the purchase of the KT Moble in Incheon Bupyeong-gu G mobile phone agency; and (c) indicated the application form for the purchase of the GT Moble in each customer name column of the application form for the purchase of the LG U Moble at the relevant location; (b) signed the application form “E”, “H”, and “E” in the applicant column; and (c) displayed the forged application form as if the two copies of the application form were duly concluded at the seat.
As a result, the Defendant forged and held two copies of the application form in the name of E, a private document on rights and obligations.
3. On August 14, 2017, the Defendant forged a private document, and the event of the said investigation document, on August 14, 2017, entered that “E”, “E”, “I”, and “E” in the applicant column into the customer name column of the site for a new service contract kept there for the purpose of being exercised by the said G mobile phone agency as indicated in paragraph (2) around August 14, 2017, and signed the forged application to the above mobile phone agency employee who is aware of the forgery at the seat.
