A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

In light of the above legal principles, the lower court erred by misapprehending the legal principles as to “J” under Article 12(1) of the former Special Metropolitan City Act, thereby adversely affecting the conclusion of the judgment.

Accordingly, for the purpose of exercising authority, the Defendant forged the application form for mobile phone entrance under the name of J, a private document related to rights and obligations.

2. The Defendant, at the time, at the place specified in paragraph 1, sent the forged mobile phone entrance application form to a public official under H, who was aware of the forgery, by facsimile, as if the document was duly formed.

1. On March 13, 2016, the Defendant forged private document: (a) at the office of the Defendant’s operation “D” located in Seocheon-gu, Seocheon-gu, Seocheon-gu, and 103, without the consent of M, the Defendant written an application for subscription to open a mobile phone before health care; (b) the Defendant, without the consent of M, signed M on the name of the customer (M), resident registration number N, address “M” *, address * * * * * * * * * * *, the applicant column stated “M” on the name subsequent to the application.

In addition, from that time until May 7, 2013, the Defendant drafted eight copies of each mobile phone subscription application in the name of M, etc. in the above eight times in total, as shown in the first list of crimes committed in the attached Table 1.

In this respect, the defendant, without authority, provided eight copies of the application for mobile phone entrance in the name of M such as M, which is a private document related to rights and duties for the purpose of exercising the right.
