Reasons
Punishment of the crime
Defendant
A is a person who has overall control over insurance business and other affairs as the head of the F Overall Headquarters in the second floor of Seocho-gu Seoul Metropolitan Government E building, and Defendant B is a person in charge of accounting affairs such as fund management of the above company.
1. Forgery of private documents and the display of private documents;
A. On April 24, 2012, the Defendants entered the name of the delegating: G, resident number: H, and address: Seodaemun-gu Seoul Metropolitan Government, Seodaemun-gu I (JB) No. 102 (JB); April 24, 2012; and “Doer G” as the title “a delegating letter” using a computer network program at the F Office of the foregoing Co., Ltd., Ltd.; and marked the said G seal which was newly stored in his/her name.
As a result, the Defendants forged a letter of delegation in the name of the above G, which is a private document related to rights and obligations without authority for the purpose of uttering in collusion, and, on the same day, at the New Bank Intermediate Financial Center in Seocho-gu Seoul, Seocho-gu, Seoul, the Defendants issued a forged power of delegation to a bank employee who is not aware of such forgery, and exercised it as if they were duly constituted.
In addition, the Defendants conspired, from the above date to May 16, 2012, forged and exercised the power of attorney in the name of G and F, and the application for bank transaction in eight times in total, as shown in the attached list of crimes (1) Nos. 1 to 8.
B. On July 23, 2012, Defendant A’s sole criminal defendant stated “(D)F” in the customer name column, “G” in the business name column, “M” in the business name column, “M” in the business address column, and “(D)F” in the lessee column, etc. at the Seocho-gu Seoul Metropolitan City Seocho-gu Seocho-gu Seocho-gu Seocho-gu Seoul, on the paper of the car rental contract (e.g., car rental contract) kept in that place, and marked the “F” in his/her name.
