A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant intended to purchase a motor vehicle with a loan from a financial institution, but it was difficult to borrow a motor vehicle because the Defendant’s credit was not good, using a certificate of the personal seal impression issued by the Defendant-friendly B and a certificate of the personal seal impression affixed by the Defendant-friendly B, and used it as if the Defendant was a representative of B and used it to obtain a loan in the name of B.

1. On August 11, 2011, the Defendant forged a private document: (a) at the office of “D” located in the Seoul Northern-gu Seoul Northern District used car sales complex; (b) in the name column of “B”, “E” in the resident registration number column, “E” in the actual residence column, and “G” in the mobile phone column; (c) at the office of “D” located in the Seoul Northern-gu Seoul Northern-gu used car sales complex; and (d) at the name column of “B”, the Defendant marked “B” in front of the name of “B” and marked in the “B” column.

계속하여 피고인은 위 일시, 장소에서 “위임장”의 수임인란에 “A”, 주민등록번호란에 “H”, 주소란에 “광주광역시 광산구 F건물 105-1206(☎ G)”라고 기재한 후 위임인란에 “2011년 8월 21일 위임인 성명 : B 주민등록번호 E”이라고 기재한 후 B의 주민등록번호 옆에 미리 새겨 가지고 있던 B의 도장을 찍었다.

Accordingly, for the purpose of uttering, the Defendant forged the “application for installment financing agreement” and “a letter of delegation” in the name of private document B, which is a private document on rights and obligations, respectively.

2. The Defendant, at the time and place specified in the above 1. Paragraph (1) above, applied for a loan to one-way employee Co., Ltd., who was aware of the forgery, and used the forged “application for installment financing agreement” and “a letter of delegation” as stated in the above 1. Paragraph (1) as if they were duly constituted.
