A on November 30, 2012, the District Court sentenced 8 months to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, etc., and the parole period was expired on May 16, 2013 during the execution of the sentence by a medical prison on parole on May 16, 2013.

피고인들은 2013. 7. 7. 23:35경 의정부시 D에 있는 E편의점 앞에서 F의 신고를 받고 출동한 의정부경찰서 G지구대 소속 경사 H이 피고인 A을 현행범으로 체포한다고 하자, 피고인 A은 "야 씨발 증거 있어, 상해진단서 있어"라고 큰소리로 욕설을 하며 계속하여 손으로 위 H의 가슴 및 어깨를 밀치면서 “내가 깜빵에 갔다 나온지 얼마 되지 않았는데 나한테 손 한번 대봐"라고 협박을 하고, 이후 지원요청을 받고 출동한 같은 지구대 소속 경장 I, 경사 J이 순찰차에 태우려 하자 발로 순찰차의 뒷문을 차면서 ”야 이 개새끼들아 내가 뭘 잘못했냐, 한번 나하고 붙어볼래“라고 하고 손으로 위 I의 멱살을 잡아 바닥에 넘어뜨리고 입으로 위 I의 오른팔 손목 부위를 물고, 피고인 B는 위 I, H이 위 A을 공무집행방해죄 등의 현행범으로 체포를 하려하자 위 H의 등 뒤에서 손으로 위 H의 왼팔을 잡아 당기고 발로 위 H의 왼발 발목을 차는 등 폭행을 하였다.

Accordingly, the Defendants conspired and interfered with the legitimate execution of duties concerning the arrest of the above H and I in the act of committing the crime.
