Reasons
Punishment of the crime
On December 28, 2018, the Defendants: (a) around the entrance of “F entertainment tavern” operated by E (hereinafter “F entertainment tavern”) in Suwon-gu, Suwon-si; (b) demanded the Defendant to leave the G District in Suwon-gu, the Suwon-gu, the police station G District in which the Defendants received 112 reports and called “Defendant A” and “I” out of the lock-si business place; and (c) Defendant A expressed the h’s breast part as “this son” and h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h’s h.
Accordingly, the Defendants conspired and interfered with the legitimate execution of duties concerning the handling of the 112 reported case by police officers, and the prevention and investigation of crimes.
[Defendant B and his defense counsel asserted that Defendant B did not use assault against police officers. However, the following facts acknowledged by the evidence presented below (i.e.,, the police officer called Defendant A who was called to the scene after receiving the 112 report at the first site after having taken care of the situation, i.e., the police officer called Defendant A, who was in contact with the H at the site, put Defendant B on the floor and attempted to arrest Defendant B, who was in the commission of the crime of obstruction of performance of official duties, with the head of the relevant body and the head of the relevant police officer, tried to capture the Defendant A, who was in contact with the Ha on the floor, as a crime of obstruction of performance of official duties; ② Defendant B’s warning the Defendant B that H may be arrested as an offender in the crime of obstruction of official duties; ② Defendant B may again go to the Defendant B; ③ the Defendant’s arrest with the police officer called Defendant B at the same time, and ④ the police officer called Defendant B at the same time with the police officer called up after the last support.
