A defendant shall be punished by imprisonment for not less than one year and six months.

Seized evidence 1 or 2 shall be forfeited from the accused.

Punishment of the crime

On January 12, 2011, the Defendant was sentenced to one year of imprisonment for a violation of the Act on the Control of Narcotics, Etc. at Seoul Southern District Court on January 12, 201, and completed the enforcement of the above sentence at Seoul Southern District Court on July 7, 2011.

On January 29, 2013, at around 23:00, the Defendant administered philophones by inserting approximately 0.03g of Metrophos (one philophone; hereinafter “philophones”) which are psychotropic drugs in a single-time injection instrument and mixing them with water to the left arms.

1. Sale of philophones to E;

A. On September 22, 201, around 22:00, the Defendant: (a) received KRW 2 million from E in front of the Changwon Station C located in the Changwon Station C; and (b) purchased and sold approximately 5 g of psychotropic drugs, psychotropic drugs.

B. On December 201, 201, the Defendant purchased and sold approximately KRW 2.8 gramphones from E in front of the said original station at the end of the said original station.

2. Sale of philophones to F;

A. On October 201, 201, the Defendant: (a) received KRW 500,000 from F in the vicinity of an express bus terminal C located in the window C of Changwon-si and purchased and sold approximately KRW 0.7 grams of philophones.

B. On November 13, 2011, the Defendant received KRW 500,000 from F to the account under the name of G used by the Defendant, along with the request to request the camphone from F, and on the same day, sent approximately 0.7g of the camphone to a high-speed bus terminal located in the Daejeon Dong-gu, Daejeon, by using express buses, and sent the camphone to a terminal of an express bus located in the Daejeon-gu, Daejeon, and had F find the camphone.

Accordingly, the Defendant traded philophones to F.

C. On December 4, 2011, the Defendant received KRW 500,000 from F to the account under the name of I used by the Defendant, along with a request to request the clopon from F, and on the same day, approximately 0.7g of the coponon in hand using express buses from the Changwon bus terminal as of the same day.
