A defendant shall be punished by imprisonment for three years.

However, the execution of the above sentence shall be suspended for a period of five years from the date this judgment becomes final and conclusive.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, he dealt with lsD, MMA, and marijuana, which are a local mental medicine, as follows:

1. Purchasing narcotics;

A. On July 2018, 2018, the Defendant: (a) connected a female-friendly F in Seocho-gu Seoul Metropolitan Government E 401 with “H”, a specialized site for selling G narcotics, etc., in the former residence of the Seocho-gu F, Seoul; and (b) decided to sell and purchase ls (J: “J”) and lsD through [sharing bulletin board].

The Defendant sent the Bitcoin equivalent to KRW 1 million to the electronic wall bags designated by I, and sent the address and photograph of the place where lsD was stored, and around two hours thereafter, the Defendant was sent from I, at around that time, after changing the address and photograph of the place where lsD was stored.

lsD 20 chapter was found and purchased.

B. On September 2018, 2018, the Defendant: (a) decided to trade L (ID “M” and MMA in the former residence of the F; (b) sent Bitcoin amounting to KRW 700,000,000 from the first floor toilets of the building located in Seocho-gu Seoul N to the 21:30 to 22:00 of the same day, and purchased MMA 10 ($ 100-150mg per unit weight) from the first floor toilets of the building located near the exit area of Seocho-gu in Seocho-gu, Seoul.

On May 9, 2018, the Defendant: (a) accessed G’s specialized sales site “P” at the G’s former residence; (b) decided to trade his/her name in secret sales (i.e., Q, etc.) and marijuana; (c) sent bitcos equivalent to the amount of KRW 560,000,000 to the former sales shop known to the said sales shop; and (d) purchased approximately five-gs of marijuana at an irregular place in Seoul, where the said sales shop was known to the said seller.

In addition, from May 9, 2018 to September 2018, the Defendant purchased approximately KRW 2710,000,00 in total, four times as shown in the following crime sight table (1).

On May 9, 2018, the remittance method volume 1.60,000 won to P.
