Punishment of the crime

The facts constituting a crime are recognized with the rhythm of the facts charged to the extent that there is no concern about substantial disadvantages to the Defendants’ exercise of their defense rights.

1. The Defendants’ co-principals Defendant A actually operated the “J” of the manufacturing industry chain, including the name, etc., in the Seo-gu Incheon, and the “L” of the manufacturing industry chain, such as the name, etc., in the Seo-gu Incheon, Seo-gu, Incheon, and operated the “O” under the name of N, which is an employee of the JJ in the name of 307 of the Seo-gu Incheon, and Defendant B exclusively sells the oil produced in the above L plant, and Defendant C is an employee of the said J.

When the Defendants came to know that middle and domestic native oil was sold at a higher price than that of domestic pre-production, they manufactured a new oil by mixing the Korean pre-production oil and the fore oil, etc. with the pre-domestic pre-production oil imported through the aboveO, and conspired to indicate and sell the oil as if the oil was imported from the beginning with the beginning in China.

Accordingly, Defendant A developed a manufacturing method that combines the garry oil or the fore oil, etc. into the native oil in China and shared the role of directly manufacturing the oil, such as the color or spath, light color, and the flabing oil in Korea; Defendant C manufactured oil in accordance with the mixing ratio known by the above Party A; Defendant C took the role of attaching the Stick indicating “China” and the manufacturing source’s “P” on the door containing the manufactured oil; Defendant B took the role of selling the oil to the customer in the condition of attaching the Stick indicating the “P” and the manufacturing source’s “P” respectively.

No person shall place any false, exaggerated, or secret labelling or advertisement concerning the indication of food traceability, such as the name, manufacturing method, quality and nutrition labelling, gene recombined foods, etc. of foods, etc., and food or food additives.
