A defendant shall be punished by imprisonment for two years.
Nos. 3, 4, 6, 8, 10, 12, 13, 15 through 17, 19 through 25, 31 of the seized evidence.
Reasons
Punishment of the crime
Defendant is not a narcotics handler.
1. Joint crimes with C - The Defendant, along with C, sought to purchase marijuana from Adi “E” (hereinafter “Aidi”) at the selling site of the deep web of the Internet.
A. On April 3, 2017, the Defendant ordered “E” to take an order for marijuana 110g, and C received approximately 110g of marijuana, which is contained in the sealed paper, at around 23:36 on the same day, after converting the amount equivalent to KRW 4.89,00 in cash into a bitco-owner and remitting it to the address of the bitco-owner known by the seller to the seller.
B. On April 5, 2017, the Defendant ordered “E” to 110g of marijuana, and C exchanged a cash amounting to 4.9 million won into a non-tcoin and transferred it to the address of the non-tcoin known by the seller, and received approximately 110g of marijuana at the above place.
Accordingly, the Defendant, in collusion with C, purchased approximately 220g of marijuana over two occasions.
2. The defendant's sole criminal conduct I - Violation of the Narcotics Control Act ( natives);
A. On March 10, 2017, the Defendant: (a) decided to purchase 2 ghopon from AdH (hereinafter “AD”) at the website of the sale of narcotics, etc. from the Internet deep web “G; and (b) transferred 900,000 won in cash to the seller’s bitcoon to the seller’s bitcoon; and (c) on March 11, 2017, the Defendant received approximately 2 gopon from AdH (hereinafter “Ad”) on the part of the seller in the sale site of narcotics, etc. from Ad H (hereinafter “G”); and (d) received approximately 90,000 won in cash from the seller’s bitcoon.
2) On March 2017, the Defendant: (a) decided to purchase 2 ghh from H “H”; (b) exchanged a cash of KRW 900,000 with a bitco to the seller’s bitcoin to transfer the money to the seller’s bitcoin; and (c) on March 2017, after a truck with no identification of the number of which is parked in the L “L” underground parking lot located in the Y in the GUK in the GU-si-si-si area, the seller is placed in the cigarette.
