Reasons
Punishment of the crime
In fact, the Defendant and B forged a lease agreement with the owner of the above land by using the fact that the Defendant knew that he is not the owner of the remaining land C, D, and E without permission even though he is not the owner of the above land, and conspired to submit it to the new Military Agricultural Technology Center.
1. According to the above public offering of forging private document forgery, the Defendant stated in Gananan-gun's Office located in F, Newanan-gun, Seoul, on January 27, 2010, the Defendant entered the real estate lease contract form in the column for marking real estate by using the official approval color pen in Chapter 1, "Newan-gun C-D", and "H" in the lessor's column, "I" in the resident registration number column, and "J" in the address column. The Defendant stated in Chapter 1 of the other real estate lease contract form as "Yan-gun E", "Haan-gun," "K," in the lessor's resident registration number column, "L", and the address column, and the name and the remainder of the lease agreement between H and the lessor's name and the remainder of the lease agreement were affixed, respectively.
As a result, the defendant and B provided two chapters of the real estate lease contract in the name of H and K, a private document related to rights and obligations, for the purpose of exercising them in collusion.
2. According to the above public offering, B applied for a landscape and plant nursery business to create a tourism infrastructure at the Newanan-gun Agricultural Technology Center located in 525, Dong-ri, Dong-ri, the said public offering around February 2010, and submitted two copies of the forged real estate lease agreement to employees of the said Agricultural Technology Center, who are aware of such forgery, as described in paragraph 1, as if it were the document duly formed.
Accordingly, the defendant and B shall submit two copies of the forged real estate lease contract to the above agricultural technology center.
