A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On April 20, 2012, the Defendant, at the “C” restaurant operated by the Defendant on B B 1st, entered the following phrases in the column where the site for a real estate lease agreement was located: “D 102, Gangwon-do Won-si,” “Building 1, 2 class neighborhood living facilities” in the building column, “l million,” “70,000,000” in the guarantee deposit column, “l million,” “E” in the lessor column, “E” in the lessor column, and “F” in the lessee column; thereafter, at a new bank located in the central Dong-dong, the Defendant filed an application for a loan to an employee under his/her name who is unaware of such forgery, and submitted the forged real estate lease agreement as above.

2. On July 10, 2014, the Defendant: (a) on the location column of the site for a real estate lease contract by using a scriptive tool at the same location as that of paragraph (1) of the same Article; (b) on the building column, the Defendant stated in the column of the site for a real estate lease contract the terms of “Do Won-si, Gangwon-do, D 102”; (c)” the terms of “l million,” “70,000,000” in the sale price column; (d) “E” in the lessor column; and (e) “G” in the lessee column; and (e) around that time, at a new bank located in the central Dong, the Defendant filed an application for a loan with an employee who is unaware of such forgery and submitted the forged real estate lease contract as seen above, as genuinely concluded.

As a result, the Defendant forged two copies of the real estate lease agreement in the name of E, a private document on rights and obligations for the purpose of uttering, and exercised two copies of the above real estate lease agreement, which is a private document on forged rights and obligations.
