Reasons
Punishment of the crime
1. Defendant B
(a) No one shall dismantle any electrical and electronic device without permission, which is a maximum speed-restricted device, except in cases falling under any ground prescribed by Ordinance of the Ministry of Information and Communication, such as inspection, maintenance, tubes, scrapping, education and research of motor vehicles;
Nevertheless, on February 1, 2016, the Defendant removed ECU data from VMT column equipment, which controls D’s maximum speed (90 km) on the road side located in Ulsan-gun, Ulsan-gun, Ulsan-gun, Halling Province, the Defendant removed the ECU data from VMT column equipment, and dismantles the maximum speed limitation device by changing its value from Winols program from that time to September 2016, and then dismantles the electric and electronic device without permission for a total of 24 times in total, as described in attached Table I, from that time until September 2016.
2. No person who accused C shall dismantle any electrical and electronic device without permission, which is a maximum speed-restricted device, except in cases falling under any ground prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport, such as inspection and maintenance of a motor vehicle, or monitoring, scrapping, education, or research;
Nevertheless, at around 13:22 on January 28, 2016, the Defendant extracted the data of the ECU that controls F in the maximum speed (90km) of G 28 tons tank freight vehicles in the street near the Jung-gu Incheon, Jung-gu, Incheon, from Emph (FGTH) to Embte (hereinafter “FGTH”), and dismantled the device of maximum speed limitation by changing its value from Wins Program and re-inception, from that time until July 1, 2016, the Defendant dismantled the electric and electronic device without permission for a total of five times from that time until July 1, 2016, as shown in the attached Table II of Crimes.
