Reasons
Punishment of the crime
1. Defendant A
(a) No person who dismantles a device with a maximum speed limitation shall dismantle any electrical or electronic device without permission, except in cases falling under any ground prescribed by Ordinance of the Ministry of Construction and Transportation for the purpose of inspecting or maintaining a motor vehicle, teaching, scrapping, education, or research;
Nevertheless, on March 26, 2016, the Defendant extracted the data of the ECU (electronic control system) which controls the maximum speed of H truck drivened by G from G in Tae-si on the cost of VMT, and dismantled the maximum speed limitation device by changing its value in the OS program, from that time until August 26, 2016, and dismantled the electric and electronic device without permission for a total of 81 times, which is the maximum speed limitation device as shown in Appendix I.
(b) Any person who intends to conduct a motor vehicle management business without registration shall register with the head of a Si/Gun/Gu as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.
Nevertheless, on December 2013, the Defendant, without registering a motor vehicle management business, was engaged in the business of maintaining unregistered motor vehicles by dismantling the device of the maximum speed limitation of the J 4.5 tons of the L4.5 tons of the L4.5 tons of the L4.5 tons of the L4.5 tons of the coast-based Highway IC, which I drive on the west-si Highway, and receiving 2.50,000 won in return from the end of August 2016 from that time to the end of August 2016.
