Punishment of the crime

[Criminal Records] Defendant A was sentenced to eight months of imprisonment for gambling in the Jeonju District Court’s military mountain branch on October 22, 2014, and completed the execution of the sentence in the military prison on June 21, 2015.

[Criminal facts]

1. Defendant B and Defendant C: (a) opened a gambling place on July 2015 at a private house, restaurant, etc.; (b) Defendant B, in charge of gambling and recruited people to participate in gambling; and (c) was in charge of management of the fee for opening gambling in the board money and the fee for opening the gambling in the board money (hereinafter “the fee”); and (d) Defendant C was willing to open a gambling place for the purpose of profit-making by entrusting a money to a person who manages or gambling money.

이에 따라 피고인들은 2015. 7. 4. 19:10 경부터 같은 날 22:35 경까지 익산시 J 개인 주택에서 성명 불상자 등 약 25명을 불러들여 화투를 각 한 장씩 세 곳에 앞이 보이게 바닥에 깔아서 도박 참여자들이 마음에 드는 숫자를 선택하여 판돈을 걸고, 화투 숫자가 높은 편이 이기는 일명 ‘ 짓고땡’ 을 진행하고, 매회 도금의 5%를 수수료 명목으로 가져 가 합계 약 500만 원 상당의 이익을 취하는 방법으로 도박장을 개설하였다.

As a result, the Defendants conspired to open a gambling place from July 4, 2015 to July 15, 2015, by opening a gambling place in a total of 10 times as shown in the annexed crime list, and thereby opening a gambling place for profit-making purposes.

2. On July 4, 2015, from around 19:10 to 22:35 of the same day, Defendant A, upon receiving a request from Defendant C to the effect that, as described in paragraph 1, B and C operate a gambling house from his private house in the following city, he would make it possible for Defendant A to smoothly return to the gambling room, with the knowledge of the operation of the gambling house, and after participating in the gambling, he participated in the gambling and thereby play a role of “total name” leading the gambling.
