1. Defendant A shall be punished by imprisonment with prison labor for a year and a fine of seven million won;

The above fine shall not be paid by the defendant.

Punishment of the crime

1. 피고인 A의 도박장소 개설 피고인 A은 경남 지역 일대 인적이 드문 주택 빈집을 빌려 바닥에 화투 패와 판돈을 놓을 수 있는 긴 모포를 설치하고, 도박에 사용할 화투를 준비한 다음, 피고인 A, D( 같은 날 기소 중지) 은 도박꾼( 속칭 선수) 을 모집하고 도박장을 총괄 관리하는 속칭 ‘ 창고 장’ 겸 많은 돈을 걸고 도박에 참여하여 각 선수들과 승패를 겨루는 속칭 ‘ 총책’ 역할을, E, F는 화투패 20매를 분배하는 속칭 ‘ 딜러( 앞 방)’ 역할을, G는 매회마다 판돈을 거두어 승자에게 나누어 주는 속칭 ‘ 상 치기’ 역할을 각 분담하여 ‘ 도리 짓고땡’ 도박판을 벌이기로 하였다.

A은 G, E, F와 공모하여 2016. 6. 13. 23:00 경부터 다음날 05:00 경까지 창원시 진해 구 H에 있는 빈 주택 내에서, 화투 패와 판돈을 놓을 수 있는 1, 2, 3번으로 구분된 긴 모포와 화투 20매 등을 준비한 다음, B, I, J, K 등 도박꾼 약 30 여명을 불러들여 1회 판돈 수백만 원씩의 돈을 걸고 속칭 ‘ 도리 짓고땡’ 이라는 도박을 하게 한 후 매회 8끗 또는 9끗이 나올 때마다 판돈의 10%를 도박장소 개설 및 편의제공 등 명목으로 징수하였다.

Accordingly, Defendant A opened a gambling place for profit in collusion with G, E, and F.

2. Defendants A and B’s gambling Defendants: (a) and D’s gambling Defendants were 1 at the same time and at the same place as paragraph 1; (b) and each 5 foot E and F, each of which is divided into 5 and 4 degrees using 100,000 won, and put up to the floor, and (c) Defendant A, B, and I, a general book for the remainder of 3 foots except for a diver’s plaque, choose one box first, and at will, among the remainder of 2 foots, from the maximum amount of KRW 10,000 to KRW 10,000,000,000 (the average total book is KRW 2 million to KRW 3 million).
