1. Defendant A shall be punished by imprisonment for eight months.

However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 피고인 A, B, C의 도박장소 개설 G은 경남 지역 일대 인적이 드문 주택 빈집을 빌려 바닥에 화투 패와 판돈을 놓을 수 있는 긴 모포를 설치하고, 도박에 사용할 화투를 준비한 다음, G, H( 같은 날 기소 중지) 은 도박꾼( 속칭 선수) 을 모집하고 도박장을 총괄 관리하는 속칭 ‘ 창고 장’ 겸 많은 돈을 걸고 도박에 참여하여 각 선수들과 승패를 겨루는 속칭 ‘ 총책’ 역할을, 피고인 B, C는 화투패 20매를 분배하는 속칭 ‘ 딜러( 앞 방)’ 역할을, 피고인 A는 매회마다 판돈을 거두어 승자에게 나누어 주는 속칭 ‘ 상 치기’ 역할을 각 분담하여 ‘ 도리 짓고땡’ 도박판을 벌이기로 하였다.

피고인들은 공모하여 2016. 6. 13. 23:00 경부터 다음날 05:00 경까지 창원시 진해 구 I에 있는 빈 주택 내에서, 화투 패와 판돈을 놓을 수 있는 1, 2, 3번으로 구분된 긴 모포와 화투 20매 등을 준비한 다음, J, D, E, F 등 도박꾼 약 30 여명을 불러들여 1회 판돈 수백만 원씩의 돈을 걸고 속칭 ‘ 도리 짓고땡’ 이라는 도박을 하게 한 후 매회 8끗 또는 9끗이 나올 때마다 판돈의 10%를 도박장소 개설 및 편의제공 등 명목으로 징수하였다.

As a result, the Defendants conspired to open a gambling place for profit-making purposes.

2. Defendants B, C, D, E, and F gambling Defendants: (a) and at the same time and place as set forth in paragraph 1; (b) Defendant B, C, and C, D, each of whom was sead with each other; and (c) each of which was divided by five parallels by five parallels, each of which was set up on the floor by using ten parallels, and (d) the remainder of three strings except with a ladr’s lag; (b) Defendant E, F, etc., one of which was first and voluntarily set up; and (c) Defendant E, and F, each of the two strings, arbitrarily selected one plaque from the highest amount of KRW 100,000 to the maximum amount of KRW 3 million (the average total volume of books is KRW 2 million to KRW 3 million).
