A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
When the Defendant instructed the obligee B to demand repayment, the Defendant used the name of husband C to make a notarial deed that C guarantees the Defendant’s obligation as a joint and several surety.
1. Forgery of private documents and the display of private documents;
A. At around 13:50 on June 3, 2013, the Defendant stated that “C shall delegate the issuance of a certificate of seal impression to the Defendant” in the letter of proxy for the issuance of a certificate of seal impression kept at one Dong office among 1 Dong-si, Seocheon-si, Seocheon-si, and signed the letter “C” in the delegating column, and affixed C’s seal impression in possession of C. For this purpose, the Defendant forged a letter of proxy for the issuance of a certificate of personal seal impression in the name of C, a private document related to rights and obligations without authority. 2) At the same time and at the same place as in the preceding paragraph, the Defendant issued the forged certificate of seal impression to D, who is an employee of the above Dong office, and exercised it as if the power of proxy was duly formed.
B. On June 3, 2013, the Defendant stated that “C is jointly and severally and severally guaranteed for ten years the Defendant’s debt payment amount to Defendant B” in the letter of delegation from the law firm FF office located in Seocheon-gu, Seocheon-gu, Nowon-gu, Seoul, Seoul, to the effect that “C is jointly and severally and severally guaranteed for ten years,” and affixed C’s seal impression in the letter of delegation. Accordingly, for the purpose of exercising rights and obligations, the Defendant forged a letter of delegation to prepare C’s private document in the name of private document in relation to rights and obligations without authority. 2) At the same time and at the same place as in the foregoing time as in the preceding paragraph, the Defendant is forged as above by the notary public attorney-at-law in charge of authentication of the FF office of the FF office.
