피고인은 2013. 6. 28. 06:30경 인천 남동구 C 노상에서 남자 두 명이 싸운다는 112신고를 받고 출동한 인천남동경찰서 소속 순경 피해자 D이 귀가를 종용하자, E 등 인근 주민들이 보는 가운데 피해자에게 “씨발, 개새끼야, 좆만한 짭새 새끼야, 확 까버릴까보다, 대한민국 경찰 좆같네, 쓰레기들”이라고 큰 소리로 말하여 공연히 피해자를 모욕하였다.
