피고인은 2016. 6. 5. 22:05경 창원시 의창구 B에 있는 창원중부경찰서 C지구대에서, 술에 취하여 아무런 이유 없이 위 지구대 소속 경위 D, 순경 E에게 “방금 어떤 짭새 새끼들이 내 가게 문 좀 뽀삿다고 바로 출동왔던데, 왜 왔노, 에라이 짭새 새끼들, 그 딴식으로 해라, 확 마 지기뿔라”라는 등의 욕설을 하고, 위 경찰관들로부터 귀가를 요청받자 계속해서 “느그 말참 싸가지 없게 하네, 씹할 놈아, 십탱이들아, 니들 언젠간 죽인다, 너그 엄마랑 자식 새끼까지 다 죽이뿐다, 니는 참 좆같네”라는 등의 욕설을 하며 소리를 지르고 삿대질을 하였다.
