A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. On December 3, 2019, the Defendant posted a notice stating that “Aphone 11 prophone is sold” on the Internet site “B” on a non-commercial site on December 16:54, 2019, and false statement stating that “Aphone 11 pro-phone is sent upon deposit of KRW 500,000 to the victim C.”

However, even if the price for the goods is paid, the defendant did not have the intention or ability to send a pro-phone 11 pro-phone which was promised.

Nevertheless, the Defendant, by deceiving the victim as above, received 500,000 won as the price for goods from the victim to the bank account (E) under the name of the Defendant.

2. On November 16, 2019, the Defendant posted a notice to the “F” on an Internet site “F” on a non-commercial site at around 21:00, stating that the Defendant would send a prophone 11 pro rata to the victim G who reported and contacted the notice.

However, even if the price for the goods is paid, the defendant did not have the intention or ability to send a pro-phone 11 pro-phone which was promised.

Nevertheless, as above, the Defendant was deprived of the victim and was transferred KRW 600,000 as the price for goods to the Hbank account (I) in the name of the Defendant.

3. On November 19, 2019, the Defendant sold a prophone 111 prophone to the Internet site J at the site of the Internet site.

The phrase "" posted a notice and falsely stating that "if 600,000 won is deposited to the victim K who reported and contacted, she will send a prophone 11 prophone."

However, even if the price for the goods is paid, the defendant did not have the intention or ability to send a pro-phone 11 pro-phone which was promised.

Nevertheless, the Defendant, by deceiving the victim as above, received 600,000 won as the price for the goods from the Hbank account (I) in the name of the Defendant from the victim.
