A defendant shall be punished by imprisonment for not more than ten months.

Reasons
Punishment of the crime
1. On October 24, 2018, the Defendant posted a letter “LG drying machine” on the Internet D on October 24, 2018, and made a false statement that “on deposit with the victim E, the Defendant will send the goods.”
However, in fact, the Defendant did not have the above drieder, and did not have funds to purchase the said drieder, and was willing to use the said drieder for living expenses or gambling funds in receipt of the price for the goods, so even if receiving the price for the goods from the victim, there was no intention or ability to send the said drieder
As such, the Defendant, by deceiving the victim as such, received KRW 1,215,00 from the victim’s bank account in the name of the Defendant to transfer KRW 1,215,00 as the price for goods, from January 4, 2019 to January 4, 201, received a total of KRW 36,00,50 from the victims in total over 25 times, as shown in the List of Crimes (1).
2. On October 24, 2018, the Defendant posted a false statement on the Internet D’s residence at Osan-si, stating that “The sale of electronic equipment, such as LG drying machine,” and reported this to the victim G, who visited the Defendant, sent television.”
However, the Defendant was not holding the said TV, and there was no fund to purchase the said TV, and there was no intention to use the said TV as a cost of living or gambling, and even if he was paid the price for the goods from the victim, there was no intention or ability to send the said TV.
As such, the Defendant, by deceiving the victim, received KRW 1,940,00 from the victim’s post office account in the name of the Defendant to transfer KRW 1,940,00 as the price for goods, from that time until December 31, 2018, received the total amount of KRW 13,448,00 from the victims eight times in total, as shown in the list of crimes (2) in the attached Table of Crimes (2).
