1. On July 29, 2018, the defrauded: (a) around July 29, 2018, the Defendant made a false statement to the effect that “On the website, the Internet used goods transaction site in the Seocheon-gu, Seocheon-gu, Gwangju, “I will sell galthot No. 4 in 65,000 won” on the Internet used goods transaction site; and (b) the Defendant made a false statement to the effect that “I will send galthno No. 4 in galthotho T. 31, 2018 if you deposit KRW 65,000 to the victim C who contacted the Defendant.”

However, since the defendant did not possess a gallon No. 4, even if he receives the price of goods from the victim, he did not have the intention or ability to send the gallon 4 to the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received 65,000 won from the victim as the price for the goods on the same day from the victim to the Defendant’s bank account (number : E).

2. 2018. 8. 17.경 사기 피고인은 2018. 8. 17.경 전항 기재와 같은 장소에서 인터넷 중고물품 거래사이트인 B 사이트에 “헹켈 칼 8종 세트를 90,000원에 판매하겠다.”는 게시글을 작성한 후, 위 글을 보고 피고인에게 연락한 피해자 F에게 “90,000원을 입금하면, 당일 헹켈 칼 8종 세트를 택배로 보내주겠다.”는 취지로 거짓말을 하였다.

그러나 사실 피고인은 헹켈 칼 8종 세트를 소지하고 있지 않았으므로 피해자로부터 물품대금을 받더라도 피해자에게 위 칼 세트를 보내줄 의사나 능력이 없었다.

3. Around September 17, 2018, the fraud Defendant written a notice around September 17, 2018 at the same place as indicated in paragraph (1) around September 17, 2018, stating that “The Defendant will sell 35,000 won ablus scis on the website, which is an Internet used goods transaction site.”
