1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On January 2, 2009, Defendant A entered into an insurance contract (hereinafter “instant insurance contract”) with Defendant B, the wife, as the insured, as shown in the attached list, as the insured.
B. On May 3, 2013, the Plaintiff acquired the instant insurance contract from the Green Damage Insurance Co., Ltd. according to the FSC’s decision to transfer contracts.
C. From January 5, 2009 to July 2, 2016, Defendant B hospitalized 28 times as indicated below (attached Table 1). Accordingly, according to the insurance contract of this case, Defendant A was paid insurance proceeds of KRW 25,830,067, Defendant B’s 4,161,837, and Defendant C’s son’s son’s son was paid insurance proceeds of KRW 4,303,506.
