1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. 1) D Co., Ltd. (hereinafter “D”)
(3) On March 18, 2009, Defendant C and the beneficiary are the insurance contract indicated in the attached list between Defendant B and the insured and the beneficiary (hereinafter “instant insurance contract”).
(1) On May 3, 2013, the Plaintiff entered into a contract with the Financial Services Commission to acquire various insurance contracts, including the instant insurance contract, from D through a decision on contract transfer (hereinafter “Plaintiff”). The Plaintiff is not divided into D and the Plaintiff, but is only called “Plaintiff”.
2) Defendant C is a parent of Defendant B.
B. Defendant C’s hospitalization and receipt of insurance proceeds began to receive hospitalized treatment at E Hospital for 16 days from December 4, 2009 to December 19, 2009 on the ground of disguised infection, and by September 1, 2015, Defendant C received hospital hospitalization over 20 days in total as indicated below, and received insurance proceeds totaling KRW 21,354,435 from Plaintiff according to the instant insurance contract.
