1. The plaintiff's main claim is dismissed.
2. An insurance contract entered into between the Plaintiff and the Defendant as shown in attached Table 1 shall be dated 2018.
Reasons
1. Basic facts
A. On June 22, 2007, C Co., Ltd. (hereinafter “C”) concluded an insurance contract with the Defendant and the insured as the Defendant, and entered into an insurance contract with attached Form 1 that covers general injury, temporary living expenses, hospitalization expenses, etc. (hereinafter “instant insurance contract”).
B. On May 3, 2013, the Plaintiff is an insurer that acquired various insurance contracts, including the instant insurance contracts, from C through a decision to transfer contracts by the Financial Services Commission.
C. From July 31, 2007 to December 15, 2016, after the conclusion of the instant insurance contract, the Defendant hospitalized a total of KRW 413 days on 21 occasions as indicated in the following table for the treatment of the inner anti-monthly damage and the crypitis, etc., and received insurance proceeds totaling KRW 55,524,238 from the Plaintiff due to the foregoing insurance accident, etc.
