A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. At around 00:40 on June 3, 2018, the Defendant: (a) stolen the victim’s market value, which was located in the victim’s 1st underground floor B, located in the calculation unit, using the gap in the victim’s place, with one cell phone and two credit cards and two physical cards in the victim’s name, which were located in the victim’s mobile phone case.
2. The Defendant violated the Fraud and Specialized Credit Financial Business Act: “F” operated by the victim’s nameless winners of the victim’s name in Busan Ho-gu, Busan Ho-gu; “F” around 01:03 on June 3, 2018; “F” around 02:55 on the same day; (a) presented the Plaintiff’s Busan Busan Busan Busan Busan Busan Busan Bank’s credit card as one’s card; and (b) paid the said amount as if it were to be one’s card; and (c) on the same day, around 04:33, the Defendant paid the victim’s nameless winners of the victim’s name in G with the amount of KRW 2.70,000,000,000 from the victim’s card; (d) presented the credit card completion as one’s card; and (e) paid the said amount, the Defendant illegally used the stolen credit card; and (e) obtained pecuniary profits equivalent to KRW 600,000 from
3. Attempted fraud.
A. On June 3, 2018, the Defendant settled KRW 9,600 at the “J” convenience store operated by the victim’s nameless winners of the victim’s name in Busan Seo-gu, Busan, and attempted to pay KRW 9,600 as stated in paragraph (1) while presenting the credit card as one of his/her card and presenting the credit card as if he/she were his/her card, but failed to do so on the wind, the approval of which is refused due to the loss of the report.
B. On June 3, 2018, the Defendant, at the “J” convenience store operated by the victims of the victim’s name in the Busan Ho-gu, Busan Ho-gu, the Defendant settled KRW 4,800, the purchase price of KRW 4,800, and presented C’s Samsung Credit Card completion as one of his/her card as stated in paragraph (1).
