Defendant shall be punished by a fine of three million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
From March 11, 2009 to July 19, 2010, the Defendant: (a) worked as a brokerage assistant at the D Licensed Real Estate Agent No. 104 of the Dacheon apartment commercial building No. 104; and (b) was delegated by F, the owner of No. 1, E apartment No. 309, which requested to conclude a monthly rent contract for the above 309; and (c) was required to pay money to G; (d) entered into a lease contract with the lessee using the owner of the F seal to receive the deposit for the lease from G; and (e) was willing to forge the monthly rent contract in the name of the tenant and deposit the monthly rent in the name of the tenant.
1. Forgery of private documents and the display of private documents;
A. On February 19, 2010, at the office of the above D Licensed Real Estate Agent, the Defendant: (a) stated “Real Estate Location” as “F” in the “Attachment E Apartment 1, 309,” “B” in the “Deposit” column; and (b) stated “F” in the name column of the lessor’s name; and (c) stated “H” in the “ broker’s name,” “H” as an authorized color pen; and then, (d) forged one copy of the whole apartment rent contract under the name of F and H, a private document on the rights and obligations of the Defendant, which is a private document for the purpose of exercising his/her prior seal affixed by the Defendant on his/her name, with the intention of using the H seal affixed by the Defendant. On the same day, the Defendant did not know that the forged apartment rent contract was duly formed.
B. On February 22, 2010, the Defendant stated “real estate location” column by means of a computer at the above D Licensed Real Estate Agent Office using the computer, “300,000 won”, “30,000 won”, “30,000 won”, and “I” in the name of the lessee and “I” as “I” in the “place of real estate location” column by means of the aforementioned D Licensed Real Estate Agent Office, and then written “H” in the name following the name of the Defendant.
