A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who has operated a child care center under the name of "D child care center" in Chungcheong City C.

1. On March 2009, the Defendant in violation of the Infant Care Act was transferred KRW 1,00,000 to the Agricultural Cooperative (F) account in the name of the above E in terms of expenses for improving the treatment of childcare staff, and KRW 1,00,000 as expenses for part-time childcare teachers was transferred to the Agricultural Cooperative (F) account in the name of the above E in terms of expenses for improving the treatment of childcare staff by falsely registering as if E, who is the husband of the Defendant, who did not work as a childcare teacher, as the husband of the above childcare teacher.

In addition, from around that time to December 2010, the Defendant received a total of KRW 23,735,000 through 22 times as shown in the attached list of crimes by means of the same method from around that time to around that time, and received a subsidy by fraud or other improper means.

2. No head of any nursery school that violates the Infant Care Act shall allow any other person to perform duties of the nursery teacher by using his/her name or the title of the nursery teacher or lend his/her certificate of qualification;

Nevertheless, from March 2, 2009 to December 31, 2010, the Defendant had a child care teacher who did not obtain a child care teacher license from the above E, and had a H who did not obtain a child care teacher license from the above E perform the duties of the child care teacher.
