A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Although the Defendant is not a person handling narcotics, the Defendant treated marijuana as follows:
1. Trade in marijuana;
A. At around 22:00, the Defendant: (a) transmitted a bitco equivalent to KRW 100,00 to the sales proceeds of narcotics, etc. to the salesroom B, which is a multilateral web site; and (b) traded marijuana by means of searching for marijuana 1g, the sales of the said narcotics, etc. under a house air-conditioning room located in Gangnam-gu Seoul at around that time, which is located in Gangnam-gu Seoul.
B. On December 25, 2019, at around 22:00, the Defendant sent bitcos equivalent to KRW 1 million to C, D, and E, etc., a sales site of narcotics, etc. on the Dak Web, and around that time, sold and purchased marijuana by means of searching 2ggs and 14gs of marijuana concealed by the said C, etc. after the air-conditioner off in Seocho-gu Seoul F building.
C. On February 22, 2020, at around 22:00, the Defendant sent a bitco equivalent to KRW 300,000 to the sales proceeds of narcotics, etc. to the salesroom B, which is a multi-welve web, and around that time, traded marijuana by finding 3g of marijuana, which is concealed in the sales of narcotics, etc. under a house air-conditioning room located in Seocho-gu Seoul Metropolitan Government.
2. Smoking marijuana;
A. B. On December 26, 2019, at around 00:00, the Defendant smoked approximately 1.5g of the marijuana purchased, as described in 1B, at the place of residence described in 2-A, in the same manner as 2-A.
C. On February 2020, the Defendant: (a) around 00:00, among marijuana purchased as described in 1(c), at the residence described in 2(a).
