A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[Relationship between the parties] B (the death of September 25, 1992) is the mother of the defendant, C (the death of December 14, 2016) is the defendant's attachment, D, E, F, and G are the siblings of the defendant, and H is the defendant's child.

Without being delegated with the authority to conclude a lease contract on the instant building, the Defendant leased the instant building without permission by forging documents in the name of B, using the fact that the instant building is located in the name of B that died on the building ledger.
[Criminal facts]
1. On February 21, 2017, the Defendant: (a) presented a letter of delegation, etc. to the “M” certified broker office located in Daegu-gu L, Daegu-gu L; (b) as if there were legitimate authority to lease the instant building, the Defendant, using the computer, stated that the said N was “B” in the column for the address of the lessor of the monthly rent contract site for real estate (ware), “P” in the resident registration number column, and “B” in the name column; and (c) made the Defendant affix B seal prepared by the Defendant in advance.
Accordingly, for the purpose of exercising, the Defendant forged the Chapter B of the Monthly Tax Agreement on Real Estate in B, a private document on rights and obligations.
2. The Defendant, at the time and place specified in paragraph 1, presented to Q Q a lessee who is unaware of the circumstances, one of the above forged real estate monthly rent contracts in the name of Q Q as if they were duly formed.
3. The Defendant shall damage property at the end of September 2017, Daegu Jung-gu.
