Reasons
1. Facts of recognition;
A. The Plaintiffs are co-owners of the Daejeon Seosung-gu E Building F (hereinafter “instant building”).
(1/2) each of the shares in possession;
On November 7, 2018, the Plaintiffs concluded a lease agreement with Defendant C with the following terms:
(hereinafter referred to as “instant lease agreement”). The lease deposit for the lease of the instant building (hereinafter referred to as “the instant lease agreement”): 50 million won: the monthly rent: 3.3 million won (including additional tax) and the 20th (Advance payment): The lease period: From December 20, 2018 to December 19, 2023 (60 months) and Article 4 (Termination of Contracts) of the lessee’s delayed payment from December 20 to December 19, 2023, the lessor may terminate this agreement immediately.
[Matters of special agreement] The part of the facility at the expiration of the contract shall be restored to its original state.
C. On November 15, 2018, Defendant C subleased part of the instant building to Defendant D, and the Plaintiffs consented thereto.
피고 C은 이 사건 건물 중 별지 1 도면 표시 ㅍ, ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㄷ, ㅍ의 각 점을 차례로 연결한 선내 ⓑ 부분(이하 ‘이 사건 건물 중 ⓑ 부분’이라 한다)에서 한의원을, 피고 D는 별지 1 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅍ, ㄱ의 각 점을 차례로 연결한 선내 ⓐ부분(이하 ‘이 사건 건물 중 ⓐ부분’이라 한다)에서 찜질방을 각 운영하였다.
F. By March 19, 2019, Defendant C paid to the Plaintiffs the amount of January 22, 2019 (from January 20, 2019 to February 19, 2019) that it was the tea, and on January 22, 2019, Defendant C was the tea of February 20, 2019 (from February 20, 2019 to March 19, 2019).
Since the payment of rent was made, it was not paid.
G. The Plaintiffs filed the instant lawsuit, to which Defendant C did not pay more than three vehicles, and the duplicate of the instant complaint indicating the intent to terminate the instant lease agreement was served on July 10, 2019 to Defendant C.
H. Articles, as shown in Annex 2 (b) of the instant building, as shown in Annex 2, and as indicated in Annex 3.1 (a) of the instant building
