The fact that the plaintiffs are the owners of land of 182 square meters in Yongsan-gu Seoul Special Metropolitan City G road, the defendant's intervenor is the owner of a building of approximately 279 square meters and its ground (hereinafter "the building of this case"), the defendant C occupies the building of this case as the lessee of the 2 and 3th floor (1,2 floor on the registry) of the building of this case, and the fact that the defendant D occupies the building of this case as the lessee of the 1st floor (the underground floor on the registry) of the building of this case, there is no dispute between the parties.

갑 2호증의 기재에 의하면, 이 사건 건물 중 별지 감정도 2 표시 ㄱ, ㄴ, ㄷ, ㅂ, ㅅ, 6, ㄱ의 각 점을 순차 연결한 선내 (나) 부분 2층(등기부상 표시: 1층) 36㎡ 및 별지 감정도 2 표시 ㄱ, ㄴ, ㅈ, ㅇ, ㅅ, 6, ㄱ의 각 점을 순차 연결한 선내 (다) 부분 3층(등기부상 표시: 2층) 20㎡와 별지 감정도 1 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ, ㅎ, 6, ㄱ의 각 점을 순차 연결한 선내 (가) 부분 1층(등기부상 표시: 지하실) 27㎡이 원고들이 소유권자인 서울 용산구 G 도로 182㎡를 침범하고 있는 사실을 인정할 수 있다.

위 인정사실에 의하면, 피고 주식회사 C는 별지 감정도 2 표시 ㄱ, ㄴ, ㄷ, ㅂ, ㅅ, 6, ㄱ의 각 점을 순차 연결한 선내 (나) 부분 2층(등기부상 표시: 1층) 36㎡ 및 별지 감정도 2 표시 ㄱ, ㄴ, ㅈ, ㅇ, ㅅ, 6, ㄱ의 각 점을 순차 연결한 선내 (다) 부분 3층(등기부상 표시: 2층) 20㎡로부터, 피고 D은 별지 감정도 1 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ, ㅎ, 6, ㄱ의 각 점을 순차 연결한 선내 (가) 부분 1층(등기부상 표시: 지하실) 27㎡으로부터 각 퇴거할 의무가 있다
