Reasons
Punishment of the crime
The Defendants of the 2014 Highest 1568 resolved that the Defendants would make profits by opening the cell phone under the name of another person through document forgery and disposing of it, Defendant A would play a role of planning and ordering a crime as a total liability for the crime, Defendant B would play a role of forging resident registration certificates, Defendant B and his accomplice, and E and F would play a role of opening the cell phone using forged resident registration certificates.
1. From July 2013 to August 1, 2013, Defendant A conspired with Defendant A to engage in a single criminal act, and the Defendant committed a forgery of the resident registration number G in the name of the Chungcheongbuk-do, which is a public document, in collusion with Defendant A, by entering his/her resident registration number, resident registration number, address, and other personal information in an unlawful way on the map of his/her resident registration certificate, without authority, for the purpose of exercising his/her right at an irregular place.
2. On August 19, 2013, the Defendants and E, F, one of the co-offenders, and E, Defendant A and one of the co-offenders of the name D, found the “J” mobile phone sales store located in Daejeon-gu H, Daejeon-gu H, and filed an application for two mobile phone purchase in the name column of the subscriber in the site for the two mobile phone purchase application form, stating that “G”, “K”, and “M” in the deposit owner column as “G”, “K”, and “M” were written in the deposit owner column and issued to the applicant column with the forged G and M’s resident registration certificate.
As a result, the Defendants conspired to forge the two copies of the application for joining a private document in the name of G, and deliver them to I as if they were a document created with the N and M resident registration certificates, which are forged public documents, and then, they receive two copies of the EL G2 cell phone from the victim I in the aggregate amount of 1,909,600 won.
