피고인은 2019. 1. 21. 16:15경 서귀포시 B에 있는 임차 건물에서 멍석, 윷, 바둑알 등을 구비한 다음 그곳을 찾은 C 등 손님들로 하여금 몇 만원 상당의 판돈을 걸고 윷을 던져 승패를 가리는 방법으로 윷놀이 도박을 하게하고, 판돈의 5%를 수수료로 취득하였다.

피고인은 이를 비롯하여 2018. 8.경부터 2019. 1. 21.경까지 사이에 위 건물에서 위와 같은 방법으로 그곳을 찾은 손님들에게 윷놀이 도박을 할 수 있는 장소 및 도구를 제공하여 윷놀이 도박을 하게 한 후, 판돈 5%를 수수료로 취득하여 525만 원 상당의 이익을 취득하였다.
