A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2016. 2. 경 성명 불상의 40대 남성으로부터 “ 내가 가지고 있는 자석 판을 땅에 묻고 윷놀이를 하면 무조건 이길 수 있다.

” 라는 제안을 받고 위 남성에게 150만 원을 지불하고 자석 판( 가로 35cm, 세로 65cm) 과 자석이 장착된 윷가락 12개를 구입한 후 마을 주민들 과의 윷놀이 도박판에서 위 자석 판과 윷가락을 이용해 윷 패를 조작하는 방법으로 윷놀이 도박판에 참가한 사람들을 속여 금원을 편취하기로 마음먹었다.

피고인은 2016. 4. 8. 경 전 남 완도 군 B에 있는 C의 주거지 마당에서, 그 전날 미리 매립해 둔 자석 판이 있는 곳으로 자석이 장착된 윷가락을 던지면 ‘ 모’ 와 ‘ 윷’ 이 나올 수 있도록 윷 패를 조작하는 장치를 한 후, 1 회당 20만 원에서 100만 원을 걸고 말 4개가 먼저 나오는 사람이 승리하는 방식의 ‘ 윷놀이 도박’ 을 정상적으로 하는 것처럼 피해자 D, E, F를 기망하여 피해자들과 윷 패가 조작된 윷놀이 도박을 하여 피해자 D으로부터 300만 원, 피해자 E으로부터 1,000만 원, 피해자 F로부터 100만 원을 교부 받아 편취한 것을 비롯하여 그때부터 2016. 11. 4. 경까지 별지 범죄 일람표 기재와 같이 총 5회에 걸쳐 8명의 피해 자로부터 합계 5,970만 원을 교부 받아 이를 편취하였다.
