1. The part of the judgment in the first instance against the Defendant-Counterclaim Plaintiff shall be revoked;

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. G is related to ownership change of 309 square meters of D forest land in Incheon Strengthening-gun (hereinafter “instant forest”) G is limited to that of Incheon Strengthening-gun E (hereinafter “E”) on July 9, 1964.

() F forest 6,148 square meters were purchased on April 30, 197 and completed the registration of ownership transfer on April 30, 1971. F forest 6,148 square meters left 5,289 square meters due to the division of land around July 30, 1984. The Defendant was donated from F forest 5,289 square meters on January 5, 1996 and completed the registration of ownership transfer on the same day. 2) The forest 378 square meters was divided from F forest 5,289 square meters on August 12, 1997 and D forest 378 square meters were divided from D forest 378 square meters to H forest 69 square meters on February 29, 2012.

B. The J newly constructed the instant building on the instant forest land and the instant land adjacent thereto (hereinafter “instant building site and building”) of 293 square meters and the instant land (hereinafter “instant building”) and on the land adjacent thereto of 465 square meters, J completed the registration of ownership transfer on or around December 30, 1981, after constructing the instant building (7.90 square meters, 77.90 square meters in a reticulate house, cement brick structure slock slive roof, cement brick slive roof, 18.80 square meters in a single-story of cement brick structure, and 15.20 square meters in a single-story of cement brick structure).

3) With respect to the instant land and building, from 1.465 square meters in I, 465 square meters in size, L 172 square meters in size, and the instant land left. 4) As to the instant land and building, M, who is K’s spouse, completed the registration of ownership transfer on March 6, 2007 due to inheritance by agreement division on September 25, 2006, and the co-defendant C of the first instance trial (hereinafter “C”) purchased it from M on July 16, 2009 and completed the registration of ownership transfer on August 31, 2009. The Plaintiff purchased it from C on February 25, 2010 and completed the registration of ownership transfer on March 4, 2010.

C. Part 1 of the instant buildings among the instant forest land, land, and buildings is 24 square meters in line with each point of Attached Form 2, 25-30, and 25, among the instant forest land.
