가. 피고인은 2013. 6. 15. 07:30경 김제시 E에 있는 F편의점 앞 노상에서, 피해자 B(18세)과 같이 술을 마시던 중 사소한 말다툼을 하다가 갑자기 손으로 피해자의 멱살을 잡고, 피해자를 바닥에 넘어뜨려 함께 뒹굴면서 주먹으로 피해자의 얼굴 부분을 수회 때려 피해자에게 약 4주간의 치료가 필요한 ‘광대뼈 및 위턱뼈의 골절’ 등의 상해를 가하였다.

B.
