Defendants shall be punished by imprisonment for six months.

However, it is against the Defendants for two years from the date of the final conclusion of the judgment.

Punishment of the crime

From August 19, 2014 to June 30, 2015, the Defendants: (a) “G Lifelong Education Center” on the F4th floor in Jeju, and (b) “I Lifelong Education Center” on the fourth floor in Jeju, from August 19, 2014 to June 29, 2015; (c) were commissioned by employers who jointly operate childcare centers to conduct workplace skill development training for childcare teachers, and received training fees from employers.

A business owner who operates a child-care center may authorize the relevant training institution to conduct workplace skill development training for the child-care teacher by entrusting the person who has worked for the school with training expenses, and where the child-care teacher has completed the education, he/she may receive a subsidy from the Jeju Special Self-Governing Province Employment Center. In order to receive the subsidy, the business owner shall enter into an agreement with the educational institution certified by the Jeju Special Self-Governing Province Employment Center for the entrustment of workplace skill development training for the child-care teacher, and if the child-care teacher, who is the person subject to education, directly finds the training and receives the training, he/she shall attend at least 80% of the training hours and complete the training course.

Nevertheless, the Defendants conspired to receive subsidies from the employers of child care centers by reporting false completion of training in order to ensure that the employers of child care centers could not receive subsidies from the Jeju Special Self-Governing Province because the training hours fall short of 80% because those subject to commissioned education did not attend the education, and thus the employers of child care centers could not receive subsidies from the Jeju Special Self-Governing Province.

Accordingly, from September 22, 2014 to the 30th day of the same month, the Defendants were going to the G Lifelong Education Center.
