A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

D Co., Ltd. (hereinafter “victim taxi company”) is a person who is engaged in driving of a Fststy taxi owned by the victim E Co., Ltd. (hereinafter “victim taxi company”), and Defendant (A) is a person who is engaged in driving of a Gsch Rexroth vehicle owned by the victim E Co., Ltd. (hereinafter “victim taxi company”).

On February 2017, the Defendant and D, using the fact that the said taxi driven by D was subscribed to the comprehensive insurance (such as large, large, 50 million won) of the cab Mutual Aid Association (hereinafter “victim Mutual Aid Association”) with the victim’s national taxi industry (hereinafter “victim Mutual Aid Association”), were willing to intentionally cause a traffic accident by neglecting the said cab vehicle driven by the Defendant as the above taxi while driving at the intersection and stopping at the atmosphere via the intersection, and to obtain money from the victim Mutual Aid Association as if it was a traffic accident.

1. On February 11, 2017, the Defendant violated the Special Act on the Prevention of Insurance Fraud: (a) started first to the L Hospital located in the Dong-si K after putting the J on the front line of the said Bosch Rexroth vehicle at Andong-si H on February 11, 2017; (b) while driving the said taxi and following the Bosch Rexroth vehicle at the same time, D opened to the front part of the said Bosch Rexroth vehicle at the speed above the elementary school in the Dong-dong-dong-dong-dong-dong-dong-dong-dong-si at around 19:53 on the same day; and (c) as D conspired, she opened to look back the front part of the said Bosch Rex vehicle at the right part above.

D As such, as if the above accident was intentionally caused to receive insurance proceeds from the victim union, it is a traffic accident caused by the failure of safety distance, immediately after the accident, it was reported to the effect that "the front car driver while driving a taxi, caused the accident caused by the wind to stop from the yellow fire" by phoneing to the Ma of the E Trade Union Chairperson, and that "the front car driver would stop from the yellow fire." On February 13, 2017, the victim union and the son by M around 14:00.
