A Imprisonment of seven years, Defendant B and C imprisonment of eight years, Defendant D imprisonment of a maximum term of six years and a short term of five years, respectively.
Reasons
Punishment of the crime
The Defendants, both of whom are nationals of large nationality, treated narcotics as follows, despite the fact that they are not narcotics handlers:
1. From January 2018 to February 2, 2018, Defendants A, B, and C, along with E, intended to import Malaysia Mat-pamper (one philopon; hereinafter “philopon”) from Malaysia C-studio to Korea. E, with the intent of concealing Defendant A’s body philopon and ordering other Defendants to deliver philopon to Korea, Defendant B, and C, who entered Korea with their body philopon while entering Korea and waiting for the place of promise first after entering Korea; Defendant B and C, first of all, planned to take charge of receiving meopon at the place of promise after entering Korea.
Accordingly, Defendant C entered the Republic of Korea from Malaysia on February 11, 2018, and Defendant B, respectively, on or around February 12, 2018, shall wait at the Gangnam-gu Seoul F hotel, the place of which was promised in advance, Gangnam-gu, Seoul. E shall be on or around February 11, 2018, in light of the written investigation report equivalent to KRW 1,997.73g (market price of 9,886,500) (market price of KRW 99,86,500) prepared in advance at the G hotel room in Malaysia, the place of which was promised in advance. However, Defendant D shall also be on the basis of the value of KRW 50,00 per 1g (Evidence evidence 500 per g, the lowest wholesale store most favorable to the Defendants, and Defendant D's criminal facts).
B was divided into four plastic bags: Defendant A’s distribution, etc.; concealed in each buckbucks as the roof; and allowed Defendant A to board the Korean Flight.
In addition, Defendant A, while concealing philophones as above, was on February 12, 2018 at around 07:20 on February 12, 2018, on the Malaysia H I, Malaysia A, and on the same day at around 14:48 on the same day.
