Punishment of the crime

The Defendants, respectively, dealt with Malaysia-based psychotropic drugs, despite the fact that they are not authorized to handle them, the Defendants dealt with the psychotropic drugs, as follows:

1. Defendant A

가. 필로폰 수수 피고인은 2018. 12. 18. 오후경 말레이시아에 있는 성명불상의 마약판매 조직원(일명 ‘C’)으로부터 휴대전화 SNS 어플리케이션인 ‘위챗’으로 “D호텔 앞으로 가면 누가 너한테 필로폰 샘플이 든 봉지를 건네줄테니 그것을 받아 두었다가 내가 지시하는 다른 사람에게 전달해 주어라.”는 지시를 받았다.

In addition, the Defendant received 2 plastic bags containing approximately 1.21g of chophonephones from the male on the name of the above “C”, which was sent from the seat of Busan Shipping Daegu D hotel in Busan.

Accordingly, the Defendant received philophones in collusion with the above “C” and the person with no name.

B. On December 2018, the Defendant and E agreed to import Malaysia along with the foregoing “C” from Malaysia to Korea, and the Defendant and E conspired to take charge of: (a) the role of having another person with a name disorder with the Defendant and E conceal the body penphone; (b) leading another person with a name disorder to enter Korea; and (c) ordering another person with a name disorder to deliver a penphone to another person with a name disorder; and (d) the Defendant and E, in accordance with the direction of the “C”, have a phiphone and enter Korea; and (c) transmitting a phiphone to Korea.

Accordingly, at around 21:00 on December 26, 2018, “C” sent to the guest rooms of Macroudio Macro-studio (on-site hours) a man on the name-free male, and divided into 20 plastic phone-phones, 4,190.59g (on-site amounting to approximately 209,50,000 won) on the two bridges of the Defendant and E, and led the Korean driver to get on the roof.

The Defendant and E are “C”.
