The sentence of this case shall be suspended.
Reasons
Punishment of the crime
1. On October 15, 2014, around 10:00 on October 15, 2014, the Defendant: (a) obtained a new physical check card in the name of the victim C in the street near the Madong-dong Hospital located in the Gyeonggi-si; and (b) did not follow necessary procedures, such as returning it to the victim; (c) embezzled the property of which possession has been abandoned.
2. On October 15, 2014, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) around 10:40 on October 15, 2014, presented to the employee, as if he had a legitimate title to the Defendant, a new e-mail card in the name of C, which was acquired and possessed as set forth in the above paragraph (1) of the said paragraph, was presented to the employee; (b) had the employee prepare a sales slip for credit cards equivalent to KRW 3,500 with the 16 goods payment settlement for the 3,500 in the 3,500 goods payment for the 3,500 goods payment for the 3,500 goods; and (c) issued and lost the credit card to the employee after signing his signature; and (d) had the employee obtain pecuniary benefits equivalent
3. Attempted fraud.
A. On October 15, 2014, around 10:42, the Defendant presented to an employee a letter of credit card sales slip equivalent to KRW 170,00,00, at the place of the foregoing paragraph (2) and (3) as if the Defendant had a legitimate title to the Defendant, and had an employee prepare a credit card sales slip equivalent to the amount of KRW 170,00,000 with the payment of goods, and the Defendant signed the signature of the member signature and attempted to obtain pecuniary profits equivalent to the said amount by avoiding the payment of goods by issuing the goods to the employee. However, the Defendant failed to make payment due to the shortage of balance.
B. On October 15, 2014, around 10:44, the Defendant presented to an employee a copy of the card, such as the above paragraph (a), at the place of the above paragraph (a) and as if the Defendant had a legitimate title to the Defendant, and had the employee prepare a credit card sales slip equivalent to KRW 80,500 via the payment of goods.
