Criminal facts
On June 21, 2012, the Defendant sentenced Chuncheon District Court to 8 months of imprisonment for night building intrusion theft, and completed the execution of the sentence on December 2, 2012.
1. On September 27, 2013, around 04:00 on September 27, 2013, the Defendant: (a) intruded the victim D’s “Ecafeteria” operated by the victim D in Gwangjin-gu Seoul Special Metropolitan City; and (b) stolen the victim’s new physical check card (F) and the Plaintiff’s new physical check card (800 won in the market price in the main bank; and (c) stolen the victim’s new physical check (F) with one unrefluent part of the market price and one transmission (800 won in the market price).
2. Violation of the Specialized Credit Financial Business Act, and fraud;
A. On September 27, 2013, around 04:27, the same day, around 04:27, the Defendant, at around 04:27, proposed to an employee J a new physical fitness card in the name of the victim H in Gwangjin-gu Seoul Special Metropolitan City, as if the Defendant was said D, that the Defendant had the said employee prepare one copy of the credit card sales slip in the name of D, which was stolen, and then used the credit card that was stolen by issuing a signature in the signature column for the sales slip, and prevented the said employee from paying KRW 45,00 from paying the above KRW 45,00 by deceiving the said employee.
B. On September 27, 2013, around 04:41 on the same day, the Defendant: (a) purchased goods equivalent to KRW 28,00,00 from the victim L L in Gwangjin-gu Seoul Special Metropolitan City’s convenience store; (b) purchased goods equivalent to the amount of KRW 28,300,00 from the victim L L; and (c) made an employee whose name is unknown, not having his/her name known, by presenting one copy of the new physical card that he/she stolen as seen above D; and (d) made the said employee prepare one copy of the credit card sales slip of KRW 28,300, the Defendant used the stolen credit card after signing the signature on the sales slip; and (d) by deceiving the said employee to pay the said KRW 28,30,00 from the victim, the Defendant acquired economic profits equivalent to the said amount.
