Reasons
Punishment of the crime
[Attachment] On June 26, 2008, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (a violation of the Act on the Punishment of Violences, etc.) at the Seoul Southern District Court on November 19, 2009 and completed the execution of the sentence on November 19, 2009.
【Criminal Facts】
1. Around April 16, 2012, the Defendant embezzled, on his/her own initiative, with a view to his/her possession, without following necessary procedures, such as acquiring a copy of the Non-self-paid Card, which was lost by the victim C at the front of the second floor of the Young Military Station 08:30, and returning it to the victim.
2. Violation of the Specialized Credit Financial Business Act, and fraud;
A. At around 08:50 on April 16, 2012, the Defendant purchased DNA tobacco 1 A at the F convenience store operated by the victim E located in Yeongdeungpo-gu Seoul Metropolitan Government, and the Defendant offered the credit card obtained from the above employees of the convenience store as if the Defendant was a lawful holder and used the credit card lost by allowing the said employees to prepare the sales slip, and by deceiving the said employees by the aforementioned method, acquired the same amount of monetary benefits from the victim by avoiding the payment of the purchase price for DNA 1 A, which is equivalent to KRW 2,100, market price of the sales slip.
B. On April 16, 2012, at the first convenience store operated by the victim H located on the third floor of Yongsan-gu Seoul Metropolitan Government Yongsan-gu G Building, the Defendant purchased DNA tobacco 2 A, and had the above employees acquire the same amount of monetary benefits from the victim by suggesting that the Defendant was a legitimate holder, and allowing the said employees to prepare sales slips. By deceiving the above method, the Defendant acquired the same amount of monetary benefits from the victim by avoiding the payment of the purchase price for DNA 2 A, the market price of which is equivalent to 4,200 won.
C. On April 16, 2012, the Defendant is operated by the Victim K in Yeongdeungpo-gu Seoul Metropolitan Government J around 11:47.
