A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On September 8, 2008, the Defendant was sentenced to 8 months of imprisonment and 2 years of imprisonment for a violation of the Public Official Election Act in the Hongsung branch of the Daejeon District Court on September 8, 2008, and was released on December 24, 2009, and the parole period expired on March 6, 2010.

In addition, on February 28, 2014, the Defendant was sentenced to imprisonment with prison labor for one year and six months for fraud in the same support, and the above judgment became final and conclusive on June 20, 2014.

The defendant, by misappropriationing the name C, was sentenced to a credit card and used it as a cash service.

1. Around July 2011, the Defendant forged private documents: (a) from the Defendant’s possession of the Defendant in Hongsung-gun D, who applied for a credit card to Samsung Card Co., Ltd. by telephone; and (b) notified the employee in charge of no name-finding of his/her address as “Songsung-gun D”; (c) informed the automatic transfer account number to “National Bank E”; and (d) notify the cell phone number to “F”; and (c) made a false call from the employee in charge of no name-finding at around 2th of the same month to request the identification of the said C’s identity.

On July 26, 2011, the Defendant received the credit card applied as above at the Defendant’s domicile in Hongsung-gun D, and entered “C” in the Defendant’s certificate of application for the issuance of the card and the receipt thereof, and signed it. The Defendant entered “C” in the applicant’s column for the personal credit information inquiry, provision, and utilization consent form, and signed it.

Accordingly, for the purpose of exercising a certificate, the Defendant forged the “written confirmation of application for issuance of a card and receipt” in the name of “A”, and the “written consent for inquiry, provision, and utilization of personal credit information” in the name of “A”, which is a private document regarding rights and obligations, respectively.

2. On July 26, 201, the Defendant’s uttering of the above investigation document is a forged “written confirmation of application for issuance of a card and receipt thereof” and personal credit information, as described in paragraph 1, at the Defendant’s domicile located in Chungcheongnam-gun Hong-gun.
