Punishment of the crime

1. Defendant A, including the identity of the Defendants, is a public official who has been in charge of bidding duties, etc. for the construction ordered by the Janananan Military Administration from around December 17, 2008 to the disaster management division, and Defendant B is the representative director of the F established for the purpose of civil engineering works, etc.

On the other hand, around February 9, 2009, Defendant B’s (State) ordered construction works for the maintenance of a small river equivalent to KRW 1,1350,000,000 from the date and time to March 19, 2010 by means of a private contract, and around March 22, 2010, Defendant B ordered construction works for a small river amounting to KRW 5,5260,000 for total construction cost by means of a small river competitive bid, etc. from February 9, 2009 to March 22, 2010, Defendant B ordered construction works for the maintenance of a small river equivalent to KRW 12,962,00 from the date and time to time from March 22, 2010 by means of a private contract or competitive bid.

2. Criminal facts;

A. On January 5, 2009, Defendant A received KRW 1 million from the above F representative B to the bank account (former Northern Bank: G) in the name of the Defendant around January 5, 2009, and received KRW 8 million over eight times from the above date and time to April 1, 2010 as indicated in the list of crimes as follows.

On April 28, 2009, Defendant A continued to receive a total of KRW 18 million from the above B through the bank account (I) of H on two occasions, and received a total of KRW 18 million.

The purpose of the solicitation is to make efforts to give orders to the Jinan-gun by free contract, etc. in order for the F to order construction works ordered by the Jinan-gun.

Accordingly, the defendant accepted a bribe in relation to his duties.

B. Defendant B issued a total of KRW 18 million over nine occasions at the same time and at the same place as in the preceding paragraph.

Accordingly, the defendant gives a bribe to public officials in relation to their duties.
