However, due to the absence of game items, the defendant did not have the intent or ability to send the above game items even if he receives the price from the injured party.

The Defendant, as above, has received 370,000 won in the name of the item price from the injured party on the same day as the foregoing, and was transferred to the foregoing Saemaul Treasury account.

Accordingly, the defendant was given property by deceiving the victim.

[2018 Highest 469] On May 5, 2018, the Defendant connected to “the wind country” online game in the Defendant’s residence located in Sin-si, Sin-si, on the following grounds: (a) posted a letter to sell “Thocheon-do Uniforms” as an item of the game; and (b) sell the said item to the Victim F who reported and contacted the said letter at KRW 600,000.

A false statement was made.

그러나 사실 피고인은 피해 자로부터 돈만 받아 가로챌 생각이었으므로, 피해 자로부터 위 돈을 받더라도 아이템을 양도할 의사나 능력이 없었다.

The Defendant, as above, received KRW 600,000 on the same day from the injured party to the corporate bank account in the name of the Defendant.

Accordingly, the defendant was given property by deceiving the victim.

1. On May 6, 2018, the Defendant, who committed the crime against the victim B, connected to the Internet game “the winding country” at a place where it is not possible to identify the place of light on May 6, 2018, posted a letter to sell the game items, “-2 solar wind,” “-2 solar wind,” and “-2 crushed wind,” and reported the above letter.
