Reasons
Punishment of the crime
Around November 14, 2017, the Defendant posted a false statement to the effect that “D” page in Ansan-si, a member C would have access to the Defendant’s mobile phone to sell cyber money in the online game, and sell the said games by accessing the items to the NAC, which sell online games using the Defendant’s mobile phone, and that if the Defendant first remitted the money to the victim E who had contacted with the said posted article, he would immediately connect the game to the game and make the cyber money out.
However, in fact, the Defendant did not own the cyber money of the above game at all, and even if he received the money from the injured party, he did not have the intention or ability to return cyber money as promised.
The Defendant, as such, by deceiving the victim, received KRW 22,00 from the Nong Bank account (Account Number:F) in the name of the Defendant around 07:49 on the same day from the injured party, and received KRW 1,970,900 in total from that time to December 27, 2017 by the same method as shown in the List of Crimes in attached Table 16 times, from that time.
around 00:52 on January 17, 2018, the Defendant, “2018 Highest 575,” sent a false statement to the effect that he/she would immediately transfer the price to the Victim J, who had access to the “HPC room” located in Ansan-si Group G, and then sold online games “the winding country”. The Defendant reported the above notice and sent a false statement to the effect that he/she would immediately withdraw cyber money when he/she first remitted the price to the Victim J.
However, in fact, the Defendant did not own the cyber money of the above game at all, and even if he received the money from the injured party, he did not have the intention or ability to return cyber money as promised.
The Defendant, as such, by deceiving the victim, was transferred KRW 136,00 to the corporate bank account (K) in the name of the Defendant around 00:56 on the same day from the victim.
